Question by : Can you sell replica items on kijiji and do i need to charge taxes?
I recently received what would be considered a replica watch from a friend as a gift. I have no need for the item so i was considering selling the item on kijiji. Then after doing a little bit of research further i discovered many people going to jail for selling replica items. so i guess my questions are:
Can you legally sell a replica item on a website garage style site like kijiji?
Can you legaly sell a replica item at a garage sale?

And i guess as a secondary question:
If i sold an item lets say my jacket on kijiji, would i need to collect taxes on that purchase? or because i had bought it new from a store, would that be double taxing?
Also my mother had a garage sale recently and i was also wondering should we have collected tax on the items sold in the yard sale?
they were all items we had previously paid for. or does that make a difference?

It would be up to the website rules to determine whether they allow replica sales, which are almost always illegal (counterfeit) to even possess, let alone sell.

If you are not “engaged in the business” of selling things, you do not generally have to collect and pay sales taxes, and each jurisdiction has guidelines for the minimum amount at which you are “deemed” to be “in the business” (e.g., over a certain amount of money or transactions within a certain time).

Similarly, if you don’t make any “profit” on your sales, then you don’t owe “income tax” on the money obtained from selling your own stuff, but it gets tricky if you buy and sell stuff on a regular basis.
